1. Scope and Acceptance

These Terms of Service (“Terms”) govern your access to and use of the website www.vibes4future.org (the “Website”), the Vibes4Steps mobile application (the “App”), and all related services, features, and content offered by Verein Vibes4Future (collectively, the “Services”).

By accessing or using the Services, creating an account, or making a donation, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

2. Provider

The Services are operated by:

Verein Vibes4Future is a tax-exempt nonprofit association recognized by the Canton of Bern.

3. Description of the Services

Vibes4Future is a charitable organization supporting people with limited mobility through technology, therapy, and direct aid. The Services include:

• an informational Website about our mission, projects, and ways to contribute;
• the Vibes4Steps App (currently iOS; an Android version is planned), which allows users to track physical activity and earn ChariToken for charitable purposes;
• the ability to make donations.

We provide the Services on a voluntary, nonprofit basis. We may add, change, suspend, or discontinue any part of the Services at any time (see Section 13).

4. Eligibility and Registration

You must be at least 16 years of age to create an account or to use features that require registration. By registering, you confirm that the information you provide is accurate and that you will keep it up to date.

Certain features (such as the App) require an account. You may hold only one account, and only one account is permitted per device, in order to protect the integrity of the ChariToken reward system.

5. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We are not liable for losses arising from your failure to keep your credentials secure.

6. Acceptable Use

When using the Services, you agree not to:

• violate any applicable law or regulation;
• manipulate, falsify, or artificially generate step data, or otherwise game the ChariToken or ranking system (e.g., through bots, emulators, or other automated means);
• create multiple accounts or use another person’s account;
• interfere with, disrupt, or attempt to gain unauthorized access to the Services or their infrastructure;
• upload malicious code or attempt to compromise the security or integrity of the Services;
• use the Services for any fraudulent, abusive, or unlawful purpose.

We reserve the right to suspend or terminate accounts that violate these rules (see Section 14).

7. ChariToken

7.1 ChariToken is an internal unit of value created by Verein Vibes4Future solely to support and gamify our charitable mission. Within the App, users’ recorded steps are algorithmically converted into ChariToken, and monthly rankings may award additional ChariToken.

7.2 ChariToken has no monetary value and no trading value. It is not a currency, security, financial instrument, electronic money, or investment. It is not listed or tradable on any exchange or marketplace, cannot be exchanged for cash, and confers no ownership, equity, profit, interest, or other financial right of any kind.

7.3 ChariToken does not constitute a claim or entitlement against Verein Vibes4Future. We may adjust the conversion rate, ranking mechanics, issuance, or any other aspect of ChariToken, and we may modify or discontinue ChariToken entirely, at any time and without compensation.

7.4 ChariToken is separate and distinct from any cryptocurrency or token operated by third parties, including the $VIBES token (see Section 9).

8. Wallet Addresses and Token Transfers

Where ChariToken is transferred to a blockchain wallet, you are solely responsible for creating and securing your own wallet and for providing a correct wallet address. Blockchain transactions are irreversible and publicly visible by their nature. We cannot reverse, cancel, or recover transactions, and we are not responsible for losses resulting from an incorrect address, a compromised wallet, or the operation of any blockchain network. Please also see our Privacy Policy regarding the processing of wallet addresses.

9. Relationship to FutureVibes and $VIBES

FutureVibes and the $VIBES token are operated by an independent third party and are not owned, controlled, or operated by Verein Vibes4Future. Nothing on our Services constitutes financial, investment, legal, or tax advice, or an offer, solicitation, or recommendation to buy, sell, or hold any cryptocurrency or token. Any interaction with FutureVibes or $VIBES is governed by that third party’s own terms and is undertaken at your own risk. Donations to Verein Vibes4Future are charitable contributions; they are not investments and carry no expectation of financial return.

10. Donations

Donations to Verein Vibes4Future are voluntary and are used to further our charitable purpose. Donations are generally non-refundable, except where required by applicable law or in the case of a demonstrable error. We may issue a donation receipt on request, subject to the information required for that purpose (see our Privacy Policy). The available donation methods are described on our donation page and may change over time.

11. Intellectual Property

All content on the Services — including text, graphics, logos, the “Vibes4Future” and “Vibes4Steps” names, designs, and software — is owned by Verein Vibes4Future or its licensors and is protected by applicable intellectual property laws. You may view and use the content for your personal, non-commercial use of the Services. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written consent, except as permitted by mandatory law.

12. Third-Party Links and Services

The Services may contain links to third-party websites or services (including FutureVibes, payment providers, app stores, and blockchain networks) that we do not control. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their respective terms and privacy policies.

13. Changes to the Services

We may modify, suspend, or discontinue all or part of the Services at any time, including features of the App and the ChariToken system, without liability, to the extent permitted by law. We will make reasonable efforts to inform users of significant changes.

14. Suspension and Termination

We may suspend or terminate your access to the Services, in whole or in part, if you breach these Terms, misuse the Services, or where required by law. You may stop using the Services and request deletion of your account at any time (see our Privacy Policy). Provisions that by their nature should survive termination (including Sections 7, 8, 9, 11, 15, 16, 17, and 19) will continue to apply.

15. Disclaimer of Warranties

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, regarding the Services, including their availability, accuracy, reliability, or fitness for a particular purpose. The Services are not intended to provide medical advice; activity tracking is for general, charitable, and motivational purposes only and is not a substitute for professional medical guidance.

16. Limitation of Liability

To the fullest extent permitted by Swiss law, Verein Vibes4Future, its bodies, members, and volunteers shall not be liable for any indirect, incidental, or consequential damages, or for any loss of data, profits, or tokens, arising from your use of or inability to use the Services. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable mandatory law (including liability for unlawful intent or gross negligence).

17. Indemnification

You agree to indemnify and hold harmless Verein Vibes4Future and its bodies, members, and volunteers from any claims, damages, or expenses arising out of your breach of these Terms or your misuse of the Services, to the extent permitted by law.

18. Privacy

Our processing of personal data is described in our Privacy Policy, which forms an integral part of these Terms.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be replaced by a valid provision that most closely reflects its original intent.

20. Governing Law and Jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-law rules and international treaties such as the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is the registered seat of Verein Vibes4Future (Kirchberg, Canton of Bern, Switzerland), subject to any mandatory place of jurisdiction provided by law, including mandatory consumer protection provisions.
